Article 3 - Management of the Service

For the proper management of the Service, STADIUM PRIME may, at any time, decide to:

- suspend, interrupt or limit access to all or part of the Service, or restrict access to the Service or certain parts of the Service, to a specific category of Users;

- Delete any information that may interfere with its operation or contravene national or international laws, or the rules of Netiquette;

The User waives all action against STADIUM PRIME as a result.

If STADIUM PRIME were to be the subject of an amicable or legal procedure due to the use of the Service, it may turn against the User to obtain compensation for all damages, sums, convictions and costs that may arise of this procedure.

Article 6.3 – Basis for the processing of Personal Data

By connecting to the Service, the user is clearly informed and freely consents to their Personal Data being processed by STADIUM PRIME.

Article 6.4 – Purposes of processing

Users' Personal Data is mainly collected in order to respond to or improve their experience on the Service.

The Personal Data of the User is processed in order to analyze the visits and behavior of the Users as well as to allow the proper functioning of the Service.

Article 8 – Conditions of access to the Service

STADIUM PRIME allows the connection between various players in the world of sport such as sports agents, clubs and athletes.

STADIUM PRIME aims to promote the economic opportunities of its members by allowing them and millions of other professionals to meet, exchange ideas, learn and seek opportunities or employees, to work and make decisions within a network of relationships of trust.

The use of the Service requires the creation by the User of a personal account. Each User registered on the Service has their own login credentials to access it. The User is solely responsible for his login credentials and STADIUM PRIME excludes all liability relating to the loss or theft of login credentials.

Article 9 - Terms of Service

The Service allows, depending on the subscription chosen by the User, to submit offers of applications, to carry out searches for offers and profiles and to submit applications.

The user is free to choose an account category among the following: Athlete, Agency or Club.

Any user can connect to STADIUM PRIME with or without a subscription.

Without a subscription, the user is only visible to other users with an account in categories different from his.

With subscription, the user can submit offers, carry out searches for offers and profiles, submit applications, depending on the subscription chosen by him.

STADIUM PRIME reserves the right to cancel, refuse or block any subscription taken out by a User with whom there is a dispute, for any abnormal request, made in bad faith, or for any legitimate reason.

TO CONCLUDE A SUBSCRIPTION AGREEMENT FOR THE SERVICE OFFERED BY STADIUM PRIME, THE USER MUST BE EITHER AN ADULT OR A MINOR WHO HAS OBTAINED THE AGREEMENT OF HIS LEGAL REPRESENTATIVES. THE USER IS LEGALLY AND FINANCIALLY RESPONSIBLE FOR ALL ITS ACTIONS REGARDING ACCESS TO AND USE OF STADIUM PRIME, INCLUDING THE ACTIONS OF ANY PERSON AUTHORIZED BY THE USER TO ACCESS HIS ACCOUNT.

THE USER AFFIRMS HAVING REACHED THE LEGAL AGE OF MAJORITY, UNDERSTANDS AND AGREES TO THESE TERMS.

IF OTHERWISE, A PARENT OR LEGAL REPRESENTATIVE OF THE USER MUST CONSENT TO THESE TERMS.

STADIUM PRIME IS FREE TO PROCEED WITH ANY VERIFICATION (identity card, bank documents, etc.) CONCERNING THE MAJORITY AND/OR PARENTAL AUTHORITY OF USERS.

Article 10 – Partnership and publication of content by users

The subscriptions chosen by the Users allow the information and the publication of a certain amount of information and textual, photographic or multimedia content (hereinafter the "Content").
Furthermore, by accepting the General Conditions, the User accepts, upon registration, to conclude a partnership with the company STADIUM PRIME concerning the information and the Content that the latter will provide and publish on the website (ads, job offers, applications , etc…) and that as such, STADIUM PRIME is free to communicate this information to any natural or legal person, on any medium, by any means and for any purpose, in particular for advertising, promotional and/or commercial purposes, with the exception of personal data.

The User expressly acknowledges the possibility of STADIUM PRIME, according to its own will, to mention, by any form of communication, by any means and on any medium, the partnership between the User and STADIUM PRIME because of its registration on the website.

The User guarantees that he holds all the necessary authorizations to provide information and put the Content online and that the putting the Content online does not infringe any possible image rights or any possible intellectual property rights.

The User also guarantees the veracity and accuracy of the Content provided and communicated by him on and/or via STADIUM PRIME.

In the event that a personal right such as an image right or an intellectual property right could be claimed on the Content posted online, the User must ensure that he is authorized to publish the Content, he guarantees that he holds all of these rights or that he has been duly authorized to publish the said Content.

STADIUM PRIME excludes all warranties and liability relating to intellectual property rights and the rights of persons such as the image rights of the Content published by the Users, which are under the sole and exclusive responsibility of the Users.

In the event of litigation or action brought by a third party against STADIUM PRIME, concerning intellectual property rights and the rights of persons such as image rights attached to Content published by a User, this User undertakes to cooperate fully with STADIUM PRIME.

STADIUM PRIME reserves the discretionary right to refuse the posting of Content or to withdraw Content without having to inform the Users, in particular for non-compliance with the General Conditions by a User or for any other legal reason and/or economically and for the proper functioning of the Service.

The User is solely responsible for all the Content he provides and guarantees that he is the owner of it and is authorized to grant STADIUM PRIME the rights to publish it on this website.

The User is responsible if any of its Content violates or infringes the intellectual property or confidentiality rights of a third party. The Content must comply with the legal rules which prohibit, among other things, discriminatory, obscene, harassing, misleading, violent and illegal content.
The User accepts that STADIUM PRIME makes available services or automated tools to translate the Content and that the Content can be translated using these services or tools. STADIUM PRIME does not guarantee the accuracy or quality of such translations, and it is the Users' responsibility to verify the accuracy of such translations.

STADIUM PRIME sets up a moderation and reporting service through which anyone can report the Content (https://stadiumprime.com/contact) for violation of intellectual property rights, violation of like or violation of any other offense or rule resulting from these Terms and Conditions or legal rule.

Article 11 – Methods of payment

STADIUM PRIME freely sets the prices of each of the subscriptions offered on the site.

The subscription is concluded for a period of one (1) year and payable, at your choice, for its entire duration or by monthly direct debit.

By way of exception, STADIUM PRIME offers sports clubs the option of taking out a so-called "per click" subscription by which they purchase a limited right of access to the Service offered by STADIUM PRIME, corresponding strictly and exclusively to the elements and content chosen by the Users and for which they subscribed.

Payment is due upon confirmation by the User of the commercial subscription subscription transaction and is made by a secure online process of double verification and strong authentication, by bank card, by bank transfer or by PayPal.

The user is informed that subscriptions will be tacitly renewed for the same period as that previously subscribed.

To avoid a renewal of his subscription, the user is free to terminate his subscription at any time, within the limit of two (2) months before the tacit renewal date.

The user is informed that any commitment for a period of one (1) year will be due by him, regardless of whether he terminates his current subscription.

In accordance with the provisions of the Monetary and Financial Code, the commitment to pay is irrevocable.

For the performance of the Service, the User authorizes a debit from his bank account of the amount relating to the price indicated. The User confirms that he is the legal holder of the card and the bank account to be debited and that he is legally entitled to use it. STADIUM PRIME reserves the right to carry out any verification concerning the majority of the paying User and/or the authorization of the minor User. In the event of an error, the impossibility of carrying out the aforementioned verifications, or the impossibility of debiting, the commercial operation is immediately canceled and automatically resolved.
The user will fulfill his obligations of payment and will accept that STADIUM PRIME saves its payment information.

He is informed and accepts that fees and taxes may be added to the prices indicated.

Failure to pay these fees will result in the termination of paid services.

Article 12 – Invoicing

In return for payment of the subscription price by the User, STADIUM PRIME undertakes to issue a detailed invoice corresponding to the commercial transaction carried out by the User electronically.

Article 13 – Severability

In the event that any provision of these Terms and Conditions is found to be illegal, void or unenforceable, such provision may nevertheless be enforced to the fullest extent permitted by law, and the unenforceable part shall be deemed severed from these Terms and Conditions. , such severance shall not affect the validity and enforceability of any other remaining provisions.

Article 14 – Applicable law

These General Conditions are subject to French law.

Article 15 – Modifications made to the General Conditions

The User is able to consult the most recent version of the General Conditions at any time on this page. STADIUM PRIME has the right, at its sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to the Service. It is the User's responsibility to regularly check whether changes have been made. Continued use of the Service following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.
